- General online terms and conditions of sale
These terms of sale are concluded on the one hand by Brasilhair, whose registered office is in PARIS, registered with the Paris Trade and Companies Register under number 810 005 116 - 00027, hereinafter referred to as Emy & Stefan, and on the other hand, by any natural or legal person wishing to make a purchase via the websites "www.brasilhair.com", hereinafter referred to as "the buyer".

Article 1 - Purpose

These terms of sale aim to define the contractual relationship between Emy & Stefan and the buyer and the conditions applicable to any purchase made through the merchant sites "brasilhair.com," whether the buyer is a professional or a consumer.
The acquisition of a good or service through these sites implies unreserved acceptance by the buyer of these terms of sale.
These terms of sale shall prevail over any other general or specific conditions not expressly agreed to by Emy & Stefan.
Emy & Stefan reserves the right to modify its terms of sale at any time.
The applicable conditions are those in force on the date of the order by the buyer.

Article 2 - Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Emy & Stefan websites:
"brasilhair.com"
These products and services are offered subject to availability.
Each product is accompanied by a description provided by the supplier.
The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly concerning colors.

Article 3 - Prices and Tariffs

Prices are indicated in euros, all taxes included (including 20% VAT).
Emy & Stefan reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include order processing, transport, and delivery costs, provided that these take place in the geographical areas specified.
Products remain the property of Emy & Stefan until full payment of the price.

Article 4 - Geographical Area

The online sale of products and services presented on the sites is reserved for buyers from all countries and for deliveries required in all geographical areas.

Article 5 - Availability

All products for sale on the sites are available.
In the event of product unavailability after an order by mail, the order will be automatically canceled, and your check will not be cashed. It will be returned to you by post at the delivery address mentioned.

Article 6 - Warranty

All hair in the Emy & Stefan range is guaranteed natural Remy.
Refund: The buyer who cancels their order before delivery must send a withdrawal letter on plain paper via registered mail to the address below.

Article 7 - Orders

Article 8 - Order Validation

The buyer, who wishes to acquire a product or service, must:
- Complete the identification form, providing all requested details or their customer number if they have one.
- Complete the online order form, providing all references for the chosen products or services.
- Validate their order after verifying it.
- Make payment under the specified conditions.
- Confirm their order and payment.
Order confirmation implies acceptance of these terms of sale, acknowledgment of having full knowledge of them, and waiver of the right to invoke their own purchase conditions or other conditions.
All data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will be considered as signature and acceptance of the operations carried out.
Emy & Stefan will send email confirmation of the registered order.

Article 9 - Available Payment Methods

Payment for purchases on Brasilhair.com can be made by:
- Credit card
- Bank check issued by a bank domiciled in Metropolitan France or Monaco, made out to: Emy & Stefan. The check is cashed upon receipt.
- Bank transfer

Article 10 - Online Payment Security

Payment security is provided by:
- Paypal (Verified by Visa, and MasterCard SecureCode certifications).
 

Article 11 - Delivery

Deliveries are made to the address indicated on the order form, which must be within the agreed geographical area.
Processing times for shipment are two working days, plus postal delivery time.
Risks are borne by the buyer from the moment the products leave the company's premises.
In case of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.
In case of payment by check, the order will be processed upon receipt of payment.
In case of shipping delay, an email will be sent to the buyer.

In the event of an unclaimed and returned package, the customer must first pay the new shipping costs before a new shipment.
 

Article 13 - Product Conformity

Emy & Stefan certifies that the hair sold on all its sites is natural Remy hair.
Emy & Stefan undertakes to exchange products that are apparently defective, damaged, or do not correspond to the buyer's order.
In this case, the buyer must state this in writing and return the product(s). Emy & Stefan will proceed with the exchange of the product(s).
The request must be made within fourteen working days following delivery. Any claim made outside this period cannot be accepted.
Return shipping costs are the responsibility of the buyer.

 

Article 12 - Returns and Exchanges: Satisfied or Exchanged

Returns must be made in their original condition, complete, and accompanied by a copy of the invoice.
The right of return cannot be exercised for items returned incomplete, damaged, worn, or soiled by the buyer.

Article 14 - Responsibility 

Emy & Stefan, in the online sales process, is bound only by an obligation of means; its responsibility cannot be engaged for damages resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems.

 

Article 15 - Archiving & Proof

Emy & Stefan will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerized records of Emy & Stefan will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.

Article 17 - Personal Data

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, personal data concerning buyers may be subject to automated processing. Brasilhair reserves the right to collect information on buyers, including through the use of cookies, and, if it wishes, to transmit the collected information to commercial partners.
Buyers may object to the disclosure of their contact details by notifying Emy & Stefan. Similarly, users have a right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
The automated processing of information, including the management of email addresses of site users, has been declared to the CNIL on October 13, 2009, registered under number 1390403. 

Article 18 - Intellectual Property

All texts, comments, logos, illustrations, and images reproduced on the "Brasilhair.com" and "formation.brasilhair.com" websites are reserved under copyright law as well as intellectual property law, worldwide.
Emy & Stefan and Brasilhair are registered trademarks.
Any total or partial reproduction of the Brasilhair.com and Brasilhair-grossiste.com websites is strictly prohibited.

Article 19 - Dispute Resolution

These online terms of sale are subject to French law.
In case of dispute, jurisdiction is attributed to the competent courts of Paris, notwithstanding multiple defendants or third-party claims.
The provisions of this order apply to contracts concluded after its entry into force.
